Terms and Conditions

1.1 Excessive CPU, Bandwidth, or Disk Space Usage: Using system resources beyond your plan’s allocated allowance or in a manner that negatively impacts other hosted customers on shared servers is strictly prohibited.

1.2 Excessive Resource Usage: Scripts, database queries, or server-side programs that consume excessive CPU or RAM (as determined by Double Focus technical team) may be restricted, optimized, or disabled to maintain server stability.

1.3 Background Processes: Running background daemon applications or cron jobs without prior written approval is not permitted and will be treated as server resource abuse.

1.4 Pornography: Hosting or transmitting pornographic, obscene, or sexually explicit content (other than legitimate fine art authorized in writing) is strictly prohibited.

1.5 Prohibited Content: Hosting, linking to, or distributing copyrighted materials without license, warez, cracking tools, phishing software, or malware is strictly forbidden.

1.6 Server Abuse: Any intentional misuse or compromise of server hardware or network infrastructure will lead to immediate account termination without refund.

1.7 Email Abuse (Spam): Sending unsolicited bulk marketing emails, spam, or maintaining open mail relays from Double Focus hosting servers is prohibited and subject to immediate IP blacklisting and suspension.

1.8 Free Reselling: Reselling any portion of our server hosting, email, or digital services free of charge to unauthorized third parties is not permitted.

1.9 Proxy Websites: Hosting proxy servers, VPN scripts, or anonymity networks is strictly prohibited on all our servers.

1.10 Storage Misuse: Server disk space is allocated exclusively for active website files and databases. Using web hosting storage as a remote personal backup or file repository is disallowed.

1.11 Media Hosting: Hosting standalone MP3 archives, piracy repositories, or heavy video download portals without designated streaming plans is not allowed.

1.12 File Download Sites: Websites operating primarily as commercial file distribution platforms are prohibited on standard hosting.

1.13 Bandwidth Use: Network bandwidth must be utilized solely for the registered web application. Hotlinking media assets from external third-party sites is prohibited.

1.14 Webmail Usage: Webmail portals are intended for immediate, temporary inbox management. Regular archival via desktop/mobile email clients using POP3/IMAP is recommended.

1.15 Adult Sites: Hosting adult entertainment portals is strictly prohibited on our infrastructure.

2.1 Account Activation: All new client accounts and hosting services are activated within 24 to 48 business hours following verified receipt of pre-payment.

2.2 Invoice Overdues: Service invoices overdue by more than 7 consecutive business days are subject to automated service suspension.

2.3 Reactivation Fee: Suspended hosting accounts or expired domains may incur a technical reactivation fee to restore live server records.

2.4 Non-Refundable Nature: Unless otherwise agreed upon in a written signed service contract or stated under our Refund Policy, advance payments and milestone disbursements are non-refundable.

3.1 Client Responsibility: Clients are encouraged to maintain their own regular off-site backups of website content, databases, and mailbox archives locally.

3.2 Server Backups: While Double Focus runs automated maintenance snapshots on shared clusters, we do not warrant or guarantee continuous availability or recovery of past iterations.

3.3 Data Loss Limitation: Double Focus holds no legal or financial liability for accidental loss of files, databases, or electronic messages resulting from client-side errors, script vulnerabilities, or server downtime.

4.1 Post-Deployment Security: Double Focus will not be held liable for website defacement, hacking incidents, malware infiltration, or unauthorized third-party access occurring after live delivery and deployment.

4.2 Third-Party Software: Any technical vulnerabilities originating from external open-source plugins, third-party themes, unverified CMS extensions, or client credential compromises fall outside the operational scope of Double Focus.

5.1 Proprietary Assets: All base code architecture, proprietary libraries, software modules, and administrative frameworks authored by Double Focus remain the intellectual property of Double Focus.

5.2 License of Use: Upon full financial settlement of the agreed proposal, the client is granted an exclusive, non-transferable license to utilize the finished website for their commercial business purposes.

5.3 Source Code Handover: Core framework project files, proprietary compilers, and internal development source systems are proprietary and not transferred or shared under turnkey hosting agreements.

5.4 File Transfer Upon Termination: In the event a client chooses to migrate to an external host, raw development files and specialized backend modules are not obligated to be handed over unless pre-stipulated under a complete source buy-out contract.

5.5 Confidentiality: Both Double Focus and the client commit to maintaining strict confidentiality regarding trade secrets, data records, and project specifications.

6.1 Limitation of Damages: Under no circumstances shall Double Focus be liable for indirect, incidental, punitive, or consequential commercial damages, including lost revenue, system outages, or business interruption.

7.1 Acceptance of Terms: By remitting payment, initiating a project, or accessing Double Focus servers, the client irrevocably confirms their acceptance of these Terms and Conditions. Double Focus reserves the right to amend these guidelines periodically.
